MATRIX Labs values your use of our MATRIX hardware products and the associated services we make available to you (the “Services”) through our website www.matrix.one, MATRIX Home, MATRIX Creator, MATRIX Voice, as well as our mobile application MATRIX app (collectively, the “Site”). In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information we obtain through the Site and the Services, including images, object recognition, location and additional environmental data gathered by the MATRIX hardware itself or through your mobile or other device with the API we make available (collectively, “MATRIX Labs Technology”).

By visiting the Site, using or downloading MATRIX Labs hardware and/or software, or using any of our Services, you understand and agree that we will handle information as described in this Policy. Your use of our Site or Services, and any dispute over privacy including information collected by MATRIX Labs Technology, is subject to this Policy and our Terms of Service, including its applicable limitations on damages and the AS A USER OF OUR SERVICES INCLUDING MATRIX LABS HARDWARE, YOU AGREE TO USE THE MATRIX LABS TECHNOLOGY AND THE SERVICES ONLY IN COMPLIANCE WITH APPLICABLE LAW.

The MATRIX Labs Terms of Service are incorporated by reference into this Policy.

What Information Do We Collect and Why?

We may collect information about you directly from you , as well as automatically through your use of our Site or Services. We also may collect information about you as an individual through our customers’ use of the MATRIX Labs technology.

Information We Collect Directly From You. Certain areas and features of our Site and Services require registration. To register you must provide your First name, Last name, email address and password. We may collect information directly from you as a data subject through our MATRIX Labs Technology or third party integrators. This information may include images that MATRIX Labs converts into computer code and non-personally identifiable data based upon biometric information including facial detection , glance detection, ethnicity, age, gender, expression, presence movement, eye tracker, pupil dilation, emotional response, distance detection, geolocation (based on the location of the specific MATRIX Labs Technology), engagement time, hair style, clothes, accessories, body tracking, body temperature, weather conditions, body type, time, and crowd measurement.

We at MATRIX Labs will not use facial detection to link image identification captured by MATRIX Labs Technology to identifying information not collected by the MATRIX Labs Technology. It is also important for individuals to understand that images captured by MATRIX Labs Technology are anonymized as they are processed by algorithms, not stored and rapidly converted into demographic data and the original image in which a person may be seen is discarded.

Information We Collect Automatically. As a visitor to matrix.one or as a customer using MATRIX Labs Hardware and/or Software, we may automatically collect the following information about your use of our Site via Google Analytics including the length of time you visit our Site and your movement through our Site. We also may collect the following information about your use of MATRIX app: mobile device ID; location and language information; device name and model; operating system type, name, and version; your activities within MATRIX app; and the length of time that you are logged into MATRIX app. Unlike information we receive through a customer’s use of MATRIX Labs Technology, we may combine this information above with other information that we have collected about you, including, where applicable, your user name, customer/employer name, your full name and password.

How We Use Information

We use information, including your personal information, for the following purposes:

  • To provide our Services to our customers, to communicate with customers about their use of our Services, to respond to inquiries, to fulfill orders, and for other customer service purposes.
  • To tailor the content and information that we may send or display via our webpages, MATRIX Labs Hardware and/or Software, to offer location customization, and personalized help and instructions, and to otherwise improve your experiences while using the Site or our Services.
  • To better understand how users access and use our Site and Services, both on an aggregated and individualized basis, in order to improve our Site and Services and respond to user desires and preferences, and for other research and analytical purposes.

To provide our MATRIX Labs services to customers including for measurement of advertising using analytics that allows customers to view advertising performance based upon the biometric and other information gathered from you, other persons or the physical environment through the MATRIX Labs Technology.

How We Share Information

We may share your information, including personal information, as follows:

  • Affiliates. We may disclose the information we collect to our affiliates or subsidiaries; however, if we do so, their use and disclosure of such information will be subject to this Policy.
  • Service Providers. We may disclose the information we collect to third party vendors, service providers, contractors or agents who perform functions on our behalf.
  • Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected to the other company.
  • In Response to Legal Process. We also may disclose the information we collect from in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
  • To Protect Us and Others. We also may disclose the information we collect where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Policy, or as evidence in litigation in which MATRIX Labs is involved.
  • Aggregate and De-Identified Information. We may share aggregate or de-identified information collected through the MATRIX Labs Technology about images captured and associated data with our customers for marketing, advertising, research or similar purposes.

Our Use of Tracking Mechanisms

We and our third party service providers use tracking mechanisms to track information about use of our Site or Services. We may combine this information with other information we collect from you on our Site (and our third party service providers may do so on our behalf).

Currently, our website does not recognize browser “do-not-track” requests.

Third Party Analytics.

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site and, to the extent permitted, our Services. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use tracking technologies to perform their services.

Third-Party Links

Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third party websites. We are not responsible for the information practices of such third party websites.

Security of Information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee 100% security.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

We have taken commercially reasonable precautions to protect MATRIX Labs Technology-collected information during storage and transmission.

Access To Information

You may modify personal information that you have submitted by logging into your account and updating your profile information. As a customer, you may access MATRIX Labs Technology information through MATRIX Labs Hardware and/or Software. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site or MATRIX Labs for a period of time.

Children Under 13

Our Site and Services are not targeted to children under 13.
